We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms, fraudulent activity, or misuse of the Service.

The Service, including all content, features, functionality, software, and design, is owned by NeverGPT and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all ownership rights to the content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your User Content solely for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary rights to submit User Content and that your User Content does not violate any third-party rights.

You own the humanized text output generated by our Service. However, we cannot guarantee that such output will be unique or free from similarity to content generated for other users.

Certain features of the Service require payment. All prices are displayed in U.S. dollars and are subject to change with notice. We reserve the right to modify our pricing at any time.

Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel your subscription.

All payments are non-refundable except as required by law or as expressly stated in these Terms. We do not provide refunds for partial months or unused portions of the Service.

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until that time.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that the humanized content will be undetectable by all AI detection tools. You use the Service at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEVERGPT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You are solely responsible for ensuring that your use of the Service complies with your educational institution's academic integrity policies. We are not responsible for any academic consequences resulting from your use of the Service.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

YOU AND NEVERGPT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

These Terms constitute the entire agreement between you and NeverGPT regarding the Service and supersede all prior agreements and understandings.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
